Terms and Conditions

The provider is Maximilian Rupp, Oberföhringerstraße 26c, 81925 Munich, Germany, contact via maximilianrupp.com/contact. These terms apply to all contracts concluded via maximilianrupp.com for digital products and services, in particular the software "Vertraut Local" and the "Vertraut, Done for You" service.

The provider is a small business under §19 of the German VAT Act (Kleinunternehmer). No VAT is charged or shown. All prices are final prices in euro.

Vertraut Studio is software the customer downloads and runs on their own device, on a monthly or yearly subscription. It includes every module, updates, new models, help inside the app and email support. The customer's documents are processed only locally; for the licence check the software sends the licence key and a version number once a month, never any content.

Vertraut Local is software the customer downloads and runs on their own device. The customer's documents are processed only locally on that device; no content is transmitted to the provider or any third party.

Vertraut, Done for You is a service in which the provider helps set the software up for the customer. Time and scope are agreed after purchase.

The presentation of products is not a binding offer. By completing payment via the payment provider (Stripe), the customer makes a binding offer. The contract is concluded when payment is confirmed.

The prices shown at the time of order apply. Payment is processed via Stripe. A receipt is provided by email.

Term and cancellation of the subscription. The monthly subscription renews by one month, the yearly one by one year, unless cancelled before the end of the current billing period. Cancellation is possible at any time to the end of the current billing period, online at maximilianrupp.com/vertraut/cancel (confirmed by email to the address on file) or in text form. Nothing is charged after cancellation.

For Vertraut Local the download is made available immediately after successful payment, and a link is also sent by email. For Done for You the service is provided by appointment.

Consumers have a statutory right of withdrawal. Details are in the Right of Withdrawal. For digital content such as Vertraut Local, this right ends once the customer expressly agrees that performance begins before the withdrawal period ends and acknowledges losing the right of withdrawal. This consent is collected at checkout.

Vertraut Studio. For the duration of the subscription the customer receives a simple, non-exclusive, non-transferable right to use the software for their own purposes on their own devices. The licence key is bound to the customer's email address. When the subscription ends, the software pauses thirty days after the paid period; the customer's documents, index, notes and templates remain on their device and can be exported at any time. After twelve paid months the customer may keep using the last provided version for good, also after a later cancellation; there is then no claim to further updates.

Vertraut Local (single licence, no longer offered). On full payment the customer receives a simple, non-exclusive, non-transferable right to use Vertraut Local for their own purposes. Sharing, distribution, or resale of the software or the licence key is not permitted.

The provider is liable without limit for intent and gross negligence, under the Product Liability Act, and for injury to life, body or health. For simple negligence the provider is liable only for breach of a material contractual duty, limited to the foreseeable damage typical for the contract. Otherwise liability is excluded. The software is provided in the form offered; fitness for a particular purpose intended by the customer is not warranted. Statutory consumer rights are unaffected.

Information on the processing of personal data is in the legal notice. Vertraut Local itself processes the customer's documents only locally on the customer's device.

The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr. The provider is not obliged and not willing to take part in dispute resolution proceedings before a consumer arbitration board.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection rules of the consumer's country of residence are unaffected. Should any provision be invalid, the remaining provisions stay in force.
