Terms and Conditions
Deutsche Fassung: AGB. The German AGB are the legally binding version; this English text is a convenience translation.
1. Provider and scope
The provider is Maximilian Rupp, Oberföhringerstraße 26c, 81925 Munich, Germany, email contact@maximilianrupp.com. These terms apply to all contracts concluded via maximilianrupp.com for digital products and services, in particular the software "Vertraut Local" and the "Vertraut, Done for You" service.
2. Small business / VAT
The provider is a small business under §19 of the German VAT Act (Kleinunternehmer). No VAT is charged or shown. All prices are final prices in euro.
3. Subject of the contract
Vertraut Local is software the customer downloads and runs on their own device. The customer's documents are processed only locally on that device; no content is transmitted to the provider or any third party.
Vertraut, Done for You is a service in which the provider helps set the software up for the customer. Time and scope are agreed after purchase.
4. Conclusion of contract
The presentation of products is not a binding offer. By completing payment via the payment provider (Stripe), the customer makes a binding offer. The contract is concluded when payment is confirmed.
5. Prices and payment
The prices shown at the time of order apply. Payment is processed via Stripe. A receipt is provided by email.
6. Delivery
For Vertraut Local the download is made available immediately after successful payment, and a link is also sent by email. For Done for You the service is provided by appointment.
7. Right of withdrawal
Consumers have a statutory right of withdrawal. Details are in the Right of Withdrawal. For digital content such as Vertraut Local, this right ends once the customer expressly agrees that performance begins before the withdrawal period ends and acknowledges losing the right of withdrawal. This consent is collected at checkout.
8. Licence
On full payment the customer receives a simple, non-exclusive, non-transferable right to use Vertraut Local for their own purposes. Sharing, distribution, or resale of the software or the licence key is not permitted.
9. Liability
The provider is liable without limit for intent and gross negligence, under the Product Liability Act, and for injury to life, body or health. For simple negligence the provider is liable only for breach of a material contractual duty, limited to the foreseeable damage typical for the contract. Otherwise liability is excluded. The software is provided in the form offered; fitness for a particular purpose intended by the customer is not warranted. Statutory consumer rights are unaffected.
10. Data protection
Information on the processing of personal data is in the legal notice. Vertraut Local itself processes the customer's documents only locally on the customer's device.
11. Dispute resolution
The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr. The provider is not obliged and not willing to take part in dispute resolution proceedings before a consumer arbitration board.
12. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection rules of the consumer's country of residence are unaffected. Should any provision be invalid, the remaining provisions stay in force.
